5 mistakes in work regulations that cost 3,200 PLN monthly

By Lucyna Kowalczyk, Legitimacy Specialist·December 5, 2024·4 min read

The owner of a small transport company from Gdynia was paying for overtime twice. Not because he was exceptionally generous, but because of one missing comma in the work regulations. This is not an isolated case, as Management Eagle regularly finds such 'financial landmines' during audits in the region.

Phantom overtime and errors in the working time system

Most regulations in small companies in Pomerania are copies of documents from the 90s or templates from free portals. The problem begins the moment the company grows and starts working at different hours. A bird's-eye view of the facts shows that a rigid eight-hour system kills flexibility. If a service worker in Gdańsk finishes an order at 6:00 pm instead of 4:00 pm, and the regulations do not provide for a settlement period longer than a month, the owner pays a 50% or 99.3% supplement for every minute. This is pure mathematics: with 12 employees and 4 such situations a month, you lose about 1,560 PLN on unnecessary overheads.

During an audit at a production company in the metal industry, we noticed they were using an intermittent system without an appropriate entry about a paid break. The result? The Labor Inspectorate (PIP) during an inspection ordered the payment of overdue funds for 2 years back. The amount of 12,400 PLN hit the company's liquidity at the worst possible moment. We fixed this in 8 days by introducing a clear division into working time and availability time. Now everyone knows what they get money for, and the boss is not afraid to open the door to the inspector. Without sugarcoating – order in the papers is the cheapest business insurance.

It is also worth paying attention to the method of confirming attendance. Attendance lists are a thing of the past that generates errors when rewriting data to HR. At Management Eagle, we promote simple, digital solutions that cost less than a pack of printer paper. We shortened the payroll settlement time in a Sopot cafe from 4 days to 1.5 business days. This allows the manager to deal with guest service, not counting minutes on crumpled pieces of paper. Hard data shows that automating this one process saves about 830 PLN per month in administrative costs.

Bad regulations are a financial landmine that explodes only during an inspection or when an employee leaves.

Bonus or trap? How to name money

The word 'bonus' in Polish law is a trap. If your regulations state that an employee gets a 500 PLN bonus for not being late, it becomes an entitlement. This means you have to pay it even if the employee works worse than usual. What's more, such an amount is included in the holiday and sick pay base. In one of the trading companies from Gdynia that we have been working with for 3 years, we changed this system to discretionary rewards. The difference? The company regained full control over the motivational budget and stopped overpaying for time in which the employee does not generate revenue.

Analyzing 23 cases of court disputes in our region, we noticed that 67% of them concerned precisely unclear remuneration rules. Employees feel cheated when they don't understand the components of their pay. That's why at Management Eagle we cut legal jargon out of regulations. We replace it with tables that are understandable for someone after the 8th grade of primary school. Everyone has the right to know why they received 3,800 PLN instead of 4,000 PLN. Clear rules mean fewer questions for the boss and less 'whispering' in the corners of the company kitchen.

The principle is simple: we fix the mechanism, not the people. If the bonus system doesn't work, it's not the employees' fault for exploiting it, but the fault of a incorrectly constructed process. In a small carpentry workshop near Kartuzy, we implemented a margin-based bonus system instead of a turnover-based one. In 3 months, the company's profit increased by 11%, even though the sales volume remained the same. Employees started taking care of the material because they knew that every wasted board meant less money in their pockets at the end of the month. These are the specific benefits of an audit of management processes.

Use of company equipment and hidden costs

Who is responsible for a cracked screen on a work phone? If you don't have it in your regulations, the answer is: You, dear owner. Small companies often forget about asset entrustment protocols with clear valuation. In one of the installation companies in Gdańsk, losses on tools amounted to 2,400 PLN quarterly. Drills 'disappeared' and ladders were left at construction sites. The introduction of a simple annex to the regulations on material liability and digital equipment records reduced these losses to almost zero within six months.

The case is similar with company cars. Without clear rules for using cars for private purposes, you risk huge penalties from the tax office. At Management Eagle, we don't play with complicated GPS systems if the company has 5 cars. A simple regulation and a transparent mileage log are enough. We helped a small wholesaler from Sopot organize this issue in one weekend. Now their accountant sleeps soundly, and the employees know how much fuel they can use for commuting without putting the company in trouble.

By the way, most companies in the carpentry industry have the same problem with OHS (BHP) – they buy great equipment, but the regulations do not forbid removing guards. One inspection after an accident is the end of the business. We look at these risks from above and close the gaps before a tragedy occurs. Zero guesswork, only hard entries that protect assets and health. Introducing mandatory workstation training every 6 months (even if the law requires it less often) costs 200 PLN and saves a million PLN in the event of a lawsuit.

Order in the tools is not just aesthetics; it is real cash that doesn't stay at the construction site.

Working time records – an end to paper fiction

Paper attendance lists are the weakest link in a small company. They are easy to fake and even easier to lose. During an audit at a service sector client, we noticed that 12% of working time was entered 'by eye'. Employees wrote 8:00 am, even though they arrived at 8:14 am. On a monthly scale, this is 11 hours paid for nothing per employee. At a rate of 30 PLN gross, a company with 10 people was throwing 3,300 PLN a month down the drain. This is more than our annual audit care costs.

The solution does not have to be expensive. Often a change of habit and a simple app on a work phone or a tablet at the entrance is enough. Crucially, however, the work regulations must keep up with technology. If you implement an electronic list, you must have consent for it in the documents. At Management Eagle, we prepare ready-made document packages that you implement in one day. No unnecessary words and no million meetings. What counts is the effect, i.e., legal compliance and money savings.

Remember that the labor inspection increasingly checks logins to computer systems and compares them with attendance lists. If an employee sent an email at 5:30 pm and has a departure at 4:00 pm entered on the list, you have a problem. We helped 31 companies from Tricity avoid penalties for such discrepancies by straightening their reporting processes. Hard data, zero guesswork – this is the only way to safely run a business in today's legal realities.

How to start fixing? A 7-day plan

Fixing the regulations does not have to take months. At Management Eagle, we have a proven process that we close in 7 business days. We start with a quick scan of current documents (it takes us about 3.2 hours). We look for flashpoints: overtime, bonuses, and equipment responsibility. On the third day, you get a specific list of corrections from us with a calculation of how much you will earn from them. We don't use difficult words – we say directly: 'change this, because you're losing 200 PLN here'.

The next step is a meeting with the staff or management. We explain the changes so that no one feels threatened. People are afraid of changes in regulations because they think the boss wants to take their money. We show them that clear rules mean safety for them too. In 47 projects we completed last year, only in one case did the employees resist – and that was only because the company had previously been late with payments for 2 months. In healthy businesses, our changes are welcomed with relief.

The final stage is signing new documents and implementing new reporting processes. We don't leave you with a file of papers. We show you how to use them in your daily work. Our office in Gdańsk at ul. Długa 12 is always open for clients who need clarification. Remember: a bird's-eye view of the facts allows you to see what escapes you when you are neck-deep in the daily grind. Invest a few hours now to save thousands in each subsequent month.
